Contractor Requests to Publish, Display, or Refer to Provision of Services to Te Papa or Output resulting from Provision of Services

Standard Contract for Services or Letter Agreement

Te Papa’s procurement contracts include the clauses:

The Contractor must not use or permit any use of Te Papa’s legal name (being Museum of New Zealand Te Papa Tongarewa), brand name, logo, slogans or any description of Te Papa (other than as expressly required under this Letter for the performance of the Services), unless the Contractor obtains the prior written consent of Te Papa (such consent to be at Te Papa’s discretion).

The Contractor must not publish, display or otherwise refer to the fact of the provision of the Services or the output of any Services (including work) in any medium, including (for example) displaying images of work on a website or in any other promotional material or referring to the performance of the Services in a CV, case studies or reference material, unless the Contractor obtains the prior written consent of Te Papa (such consent to be at Te Papa’s discretion).

Te Papa’s Practice regarding Contractors and Use of Te Papa name & brand

Te Papa receives a large number of requests from service providers, suppliers and contractors who wish to advertise their association, or work undertaken for Te Papa for professional promotional purposes. The Te Papa brand is a commercial asset, and the exclusive right of brand association is a key benefit that we offer our major sponsors. In addition as a Crown entity we need to ensure that the reputation of Te Papa is maintained at the highest levels and that extends to any direct or inferred association with its suppliers. Sponsorship contributes a significant proportion of Te Papa’s operating revenue, and we are very mindful to protect and maintain the relationships we have, and this includes being vigilant in respect of any actual or implied relationship with Te Papa.

The practice Te Papa has adopted is that we are willing to approve the inclusion, in a portfolio listing, of a reference (including images or footage of the work) that work has been undertaken for Te Papa, subject to authorisation to ensure that the reference is accurate and appropriate and any images and footage has been approved. However, authorisation for the use of the Te Papa brand (including the thumbprint logo and other registered trademarks) will be in exceptional circumstances only, and only where there is a tangible benefit arising from the use to Te Papa, or one of its sponsorship partners. This practice applies to any publicly available published material, including websites, and marketing/promotional materials.

Te Papa’s Process

Send a request for permission and a mock-up of the text referring to your company’s work for Te Papa to Bridgette Yates, Marketing Manager Bridgette.Yates@tepapa.govt.nz

Whomever receives your request will conduct an accuracy check with the Te Papa staff member managing the contract for services with your company and will also ensure that any images or footage you wish to use do not contain third party content where there may be issues granting consent.
